Holders of Gibraltar identity cards and persons resident before that date are not affected. Since 6 October 2025, ordinary residence in Gibraltar has been governed by published criteria that tie eligibility to genuine economic contribution. For an applicant relying on employment, this means a qualifying salary at the average gross annual earnings, an employer that has traded in or from Gibraltar for at least a year and is current on its licensing, payments and filings, suitable accommodation, and an age of 55 or under, subject to the Chief Minister’s discretion. The standing of the employing business now bears directly on whether a prospective employee qualifies, and the discretionary gateways and the transitional treatment of those present before 6 October 2025 are the points on which advice most often turns.
