Artificial intelligence is driving a new category of legal risk centred on responsibility, attribution, control, and definition. Definition matters because the practical question increasingly presented is what, in law, a “persona” is, which of its attributes are capable of proprietary protection, and which remedies attach when that persona is replicated at scale through synthetic media.
In the United Kingdom, the UK Jurisdiction Taskforce has taken the position that the private law of England and Wales contains sufficient resources to allocate responsibility for AI-enabled harms without radical legislative reform. Its draft Legal Statement on liability for AI harms analyses how established principles of fault, causation, and responsibility can be applied to systems that operate with increasing autonomy, including in circumstances where the internal reasoning of the system is opaque and evidentially difficult to interrogate. A different response is visible in the United States, with potential relevance elsewhere. Matthew McConaughey has reportedly pursued a strategy of securing trademark registrations connected to his voice, likeness, and associated indicia, with the apparent objective of creating a clearer and more scalable enforcement route against unauthorised deepfakes and related synthetic uses. The interest in that move lies in its character. It treats elements of identity as registrable commercial assets and seeks to convert a diffuse set of personality and misappropriation claims into a more structured intellectual property position that can be policed through registration-based rights.
The two developments sit in productive tension. The Taskforce’s analysis is addressed to legal capacity at the level of doctrine. The McConaughey strategy illustrates how legal demand is likely to express itself in practice when clients want front-loaded protection that reduces litigation uncertainty and accelerates enforcement. The latter also brings the definitional question to the foreground. The liability analysis allocates responsibility after harm has occurred. Trademark strategy seeks to define protectable subject matter in advance, then relies on that definition as the anchor for enforcement.
Jurisdictional differences remain relevant. The United States and England and Wales approach personality and image protection through different doctrinal routes. The global circulation of synthetic media nonetheless means that protective strategies adopted by high-profile individuals in one jurisdiction can signal emerging expectations elsewhere, particularly where existing remedies are perceived as slow or uncertain.
The broader point is structural rather than jurisdiction-specific. Legal systems may be capable of responding to AI-enabled misuse through existing principles, while practitioners and rights-holders continue to seek clearer, more immediate forms of control. Where technology accelerates replication and dissemination, demand tends to coalesce around mechanisms that define rights early and support predictable enforcement across platforms and borders.
