Legal 500 Comparative Guide: Gibraltar Gambling Law Q & A

The Hassans Gambling Team have contributed to the latest Legal 500 Gibraltar Gambling Law Guide (Gibraltar: Gambling Law – Country Comparative Guides). The Guide provides a deep dive into the upcoming regulatory changes and the strategic opportunities that come with a Gibraltar Gambling Licence. 

Some of the key changes highlighted in the Guide include:

1. An Expansion of the Scope and Triggers for Licensing 

The new Gibraltar Gambling Act (the “New Act”) introduces a broader definition of ‘gambling’ than its predecessor Act, the Gambling Act 2005. The triggers for licensing have also increased significantly with the historic sole trigger for licensing (having remote gambling equipment in Gibraltar) now being one of five triggers to licensing under the New Act. 

2. New Licence Types

The New Act introduces new licences which are tailored to specific activity types (for example, specific licences for B2C and B2B remote and non-remote gambling). For the first time, Gibraltar will introduce a Gambling Operator's Support Services Licence, which cover marketing services for gambling, holding entities for gambling carried on elsewhere and the holding or manging of customer funds. 

3. Increased Oversight and Enforcement Powers

Key oversight and enforcement changes include the increased enforcement powers of the Gambling Commissioner and the introduction of a Gambling Appeals Tribunal for the first time in Gibraltar.
